RAKSHA MANTRI’S COMMITTEE OF EXPERTS

RAKSHA MANTRI’S COMMITTEE OF EXPERTS
REVIEW OF SERVICE AND PENSION MATTERS
INCLUDING POTENTIAL DISPUTES, MINIMIZING
LITIGATION AND STRENGTHENING INSTITUTIONAL
MECHANISMS RELATED TO REDRESSAL OF
GRIEVANCES

The Committee would therefore recommend that the Ministry, under the
JCM or by way of any other consultative mechanism, by involving
stakeholders, must, within a period of three months, undertake to
meticulously examine all such problems that have arisen due to anomalies
perpetrated by implementation of ACP or MACP, especially with regard to
restructuring of Artisan staff, issues related to movement from Highly
Skilled to HS-I, grant of ACP/MACP to security staff of OFB etc. We have
been informed that the issue related to Highly Skilled and HS-I staff had
been addressed by a decision of Kolkata Bench of the CAT but while two
decisions were implemented, two were challenged before the High Court. If
this is correct, it may be ensured that no such discrimination is caused to
employees and the decisions if implemented and accepted for a section of
employees must be implemented for other similarly placed employees also.
The minor issue related to Special Pay of Staff Nurses working in Operation
Theatres must also be addressed within a period of three months from the
submission of this Report.

1.ACP Aug.99 to 31/08/2008 for IES

provisions of the MACP Scheme shall be given by the Department of Personnel and

Training (Establishment-D). The scheme would be operational w.e.f. 01.09.2008. ln

other words, financial upgradations as per the provisions of the earlier ACP Scheme (of

August, 1999) would be granted till 31.08.2008.

(MACP)19/05/2009

No.35034/3/2008-Estt. (D) Dt. 19/05/2009

2.3rd MACP

11. It is clarified that no past cases would be re-opened. Further, while

implementing the MACP Scheme, the differences in pay scales on account of grant of

financial upgradation under the old ACP Scheme (of August 1999) and under the MACP

Scheme within the same cadre shall not be construed as an anomaly.

No.35034/3/2008-Estt. (D) Dt.19/05/2009

(ii) While carrying out the restructuring as per Ministry of Defence letter of even number dared 14th June 2010,Financial up gradation (in the Pay scale of Rs.5000-8000),granted to the Highly Skilled Workers (in the Pay scale of Rs.4000-6000) between the period from 01-01-2006 to 31-08-2008 under ACP Scheme of August,19999,will not be withdrawn as a one time measure.

MoD I.D.No.11(5)/2009-D(Civ-I)dated 1st December 2010 point No. II & No.35034/3/2008-Estt. (D) Dt. 19th May, 2009

3.For reconstruction of 4grade

(ii) While carrying out the restructuring as per Ministry of Defence letter of even number dared 14th June

2010,Financial up gradation (in the Pay scale of Rs.5000-8000),granted to the Highly Skilled Workers (in the Pay scale of Rs.4000-6000) between the period from 01-01-2006 to 31-08-2008 under ACP Scheme of August,19999,will not be withdrawn as a one time measure.

That mean those are promoted from HS to HS II to HS I & HS I to MCM HS I not treated as promotion due to

11. It is clarified that no past cases would be re-opened. Further, while

implementing the MACP Scheme, the differences in pay scales on account of grant of

financial upgradation under the old ACP Scheme (of August 1999) and under the MACP

Further Mof D clarified that

(ii) While carrying out the restructuring as per Ministry of Defence letter of even number dared 14th June

2010,Financial up gradation (in the Pay scale of Rs.5000-8000),granted to the Highly Skilled Workers (in the Pay scale of Rs.4000-6000) between the period from 01-01-2006 to 31-08-2008 under ACP Scheme of August,19999,will not be withdrawn as a one time measure.

If you treated HS I promotion then (in the Pay scale of Rs.5000-8000),granted to the Highly Skilled Workers (in the Pay scale of Rs.4000-6000) between the period from 01-01-2006 to 31-08-2008 under ACP Scheme of August,1999,will not be withdrawn as a one time measure.

This order is meaning less because HS I treated as promotion that mean without withdrawn you cant pleased in HS I

Same who have placed In MCM before 31/08/2008 you treated as promotion in HS I

Then its not follow as per MACP order 11.

That mean past cases reopened.
